a) Discuss, with reference to statutory provisions and judicial decisions, the circumstances in which an offer may be terminated.   (10m)

b) On 6th January, Nizam makes an offer to sell goods to Najib by letter. On 10th January, Najib writes back accepting the offer. On 11th January, Najib telegrams Nizam: "Have changed my mind. Ignore letter of 10th." Having received the telegram, Nizam sells the goods to Hakim on 12th January. On 13th January, Najib's letter dated 10th January arrives. That afternoon Najib telephones Nizam to tell him that he now wishes to proceed with the deal. Nizam, having already sold the goods to Hakim, is not in position to oblige Najib.
